Scope of authority and manner of acting of the Market Inspection Sector
The Market Inspection Sector, within the Ministry of Trade, Tourism and Telecommunications, inspects the production and trade of goods that infringe intellectual property rights (trademark, design, patent, small patent, geographical indication, topography of semiconductor products, copyright and related rights), as well as control over the production and trade of goods protected by copyright and related rights.
In addition to the general powers prescribed by the Law on Public Administration for all bodies performing inspection supervision, and in addition to the general powers of the market inspector prescribed by the Law on Trade and the Law on Inspection Supervision and applied in ex officio proceedings, the Market Inspection Sector has:
– special authorizations for the effective protection of intellectual property rights, which it undertakes ex officio or at the request of the holder of intellectual property rights;
– rights and duties within the inspection supervision over the implementation of the Law on Optical Discs, which it applies in accordance with that law.
